Your privacy is important to Hudl, Inc. and its subsidiaries (“Hudl”, “we”, “our”, or “us”). Hudl is committed to protecting your personal information. This Privacy Policy explains what information Hudl collects, how such information is collected, used, shared, and protected by us, and what choices and rights you may have when you use Hudl’s websites, platforms, mobile applications, software, hardware, and other products and services we offer (collectively, the “Services”).

In this Privacy Policy, a “Customer” means a team, school, district, club, league, or other organization that has a separate agreement with Hudl for use of the Services. This Privacy Policy applies to personal information Hudl collects from and about individual users of the Services. 

You can find details about personal information collected from children in Section 9 of this Privacy Policy.

To make sure your personal information is secure, we communicate our privacy and security guidelines to Hudl employees and strictly enforce privacy safeguards within the company.

Please read this Privacy Policy before accessing or using the Services or providing any personal information to Hudl.

If you do not wish to have your information used and disclosed as provided in this Privacy Policy, please refrain from providing your information and/or delete the information you may have submitted in the past. In doing so, please understand that your access to information, Services and other benefits may be substantially limited. Further assistance is available via email to support@hudl.com.

If you use Hudl’s Services, further information may also be provided in your contract with us. If you are an employee, worker or contractor of Hudl, the information about how we handle your personal information is available in the Hudl Handbook. With respect to employees based in Europe and the UK, we are committed to cooperating with EU and UK data protection authorities and comply with the advice given by such authorities with regard to human resources data transferred from the EU or UK in the context of the employment relationship. If you are a prospective employee or job applicant of Hudl, we will provide you with information about how we handle your personal information for recruitment purposes. This will be provided to you if you commence any of our recruitment initiatives.

1. Collection and Use of Personal Information

Personal information is data relating to a person that can be used to help uniquely identify them, either directly or indirectly. Depending on the Services you use and the context in which you use them, personal information may include information you provide to us, information that we collect automatically, information that we receive from Customers or other users, and information from other sources. If you do not provide us with certain requested personal information, we may not be able to provide some or all of the Services you request.

Hudl may use your personal information to provide, operate, administer, support, secure, personalize, and improve the Services; to process transactions when you place an order or register for coaching, camps, clinics, leagues, tournaments, memberships, enrollments, or other activities or events (collectively, "Programs") through the Services; to process donations and coupon book purchases you make through Hudl’s fundraising-related Services; to provide customer support; to communicate with you; to maintain security and prevent fraud or misuse; to meet our legal obligations; to enforce our terms and agreements; or otherwise where you direct us or give us consent to use your personal information. Hudl may send you periodic marketing and promotional emails, push notifications, or text messages about Hudl Services or third party products or services, and we will obtain your consent to do so, where required by law. For information on notifications to children under 13, see Section 9. If you no longer wish to receive our marketing and promotional communications, you may opt out of receiving them by following the opt-out instructions included in any communication that you receive from us or by contacting support@hudl.com. Please note that even if you opt out of receiving marketing and promotional communications from us, we may still send you administrative and transactional messages from which you cannot opt out. We may promote our Services by publishing advertising on our own Services and by placing ads on third parties’ services, and we may also provide advertising services for third party advertisers. We may also use your personal information to provide and improve our advertising services, including how we target and measure our publishing of ads for third party advertisers.

We may use your personal information for purposes such as auditing, data analysis, research, product development, improvement of the Services, security, and customer communications. Hudl and its partners may share your personal information and use it as described in this Privacy Policy. Such information may be combined with other information to provide and improve Services, content, and advertising. This Privacy Policy does not cover, and is not intended to restrict, what we do with information that has been aggregated, de-identified, or anonymized, so that it is no longer associated with an individually identifiable user. Please note that we may combine personal information that we collect (as described above) with information from other sources and use the combined information for the purposes described in this Privacy Policy.

Certain Services of Hudl may use the YouTube API Services (“YouTube API Services”) to allow you to authorize Hudl to connect to your YouTube account in order to livestream using YouTube. Any personal information you provide when using YouTube API Services is governed by the Google Privacy Policy (https://www.google.com/policies/privacy). By authorizing Hudl to connect to your YouTube account, we will obtain, collect, store, and use information related to your YouTube channel, which allows us to stream video to YouTube on your behalf. This information includes your channel ID, channel name, and authorization tokens (“YouTube API Data”). You can revoke the access of Hudl’s Services to your YouTube API Data via the Google security settings page at https://security.google.com/settings/security/permissions.

Certain Services use artificial intelligence technology (“AI”) to help match athletes in video to their player profiles in Hudl, generate statistics, produce summaries or insights, support analysis, or enable other product features. AI features in the Services may be provided by one or more third-party services providers. Depending on the feature, AI may process video, images, audio, prompts, outputs, telemetry, player profile information, performance information, and other personal information. In certain cases, AI matches athletes to player profiles based on their jersey numbers or clothing. In other cases, the AI matches athletes to player profiles based on their general appearance in the video – things like their hairstyle, shoes, or general look are grouped together to show a representative image of the player. In either instance, the coach or team admin matches the group of AI images of the presumptive player to the correct player profile. Through AI tracking, our Services can create player statistics tied to a player profile. We may use uploaded videos and pseudonymized usage data to train our AI model and improve our Services.

The Services may also utilize AI to generate summaries and insights based on analysis of various data sources, which may include, among other sources, publicly available information and third-party datasets. When a user requests a summary, the generated content may include personal information if such information exists within the analyzed data sources.

The Services may also include the ability to interact with Hudl’s support chatbot or support voice assistant. These support tools are powered by AI, and a human representative from Hudl is not involved in these automated chats or calls. We use a third-party provider for these Services. The chatbot may assist with certain account-related actions, including making changes to your account, without human intervention. Your personal information may be collected and/or updated from these interactions.  We may use transcripts and recordings of your interactions (including text chats and voice calls) and pseudonymized usage data to train our AI models and improve our Services.

2. Personal Information We Collect

When you visit our website(s), download or install a software application, use any of our Services, interact with our support chatbot, create an account, purchase or register a product (including our Hudl manufactured devices), register for Programs, participate in an event/combine with Hudl or an event partner/Combine Partner, complete a survey, sign up for a newsletter, enter a sweepstakes, participate in a promotion, attend an event of ours, or download a software update, we may collect personal information, including but not limited to: name, account number, mailing address, phone number, email address, relationship information (for family members/children), Athlete Profile and other profile information (as described in Section 3 below), event/combine registration and results information, contact preferences, health information, purchase history, viewing and ticket/custom item information, communications on our Services, credit card information and payment history, donation and coupon book purchase history, and fundraising campaign participation.

We may also collect such information when you contact us in person (for example, at clinics, conferences, workshops, seminars and other events) or via telephone, facsimile, email, or within our Services. When you send us an email, that email address will be recorded automatically for purposes of replying to your email.

If you have a Hudl account, including where you represent an organization such as a professional sports club or otherwise, or have subscribed to our email list, where permitted by law, you subscribe to our electronic newsletters and product updates to be sent to the email address used with your Hudl account. Such newsletters and updates may include information about new features and new services. You may unsubscribe from this content by following the steps detailed in the email footer or by contacting support@hudl.com.

We may receive and store certain types of website usage information when you visit our websites. Website usage information helps us determine how visitors arrive, what type of content is most popular and which visitors are interested in particular content and advertising. We may collect the page visited, the time, the source of the request, the type of browser making the request, the preceding page view, and other information about your engagement with our site and Services. We may also collect your IP address and your Device Identifier. A “Device Identifier” is a number automatically assigned to the computer, cell phone or tablet used to access the internet. We may associate your Device Identifier with the personal information you provide.

If you wear a wearable device either manufactured by us or used with our Services, certain information such as the following may be automatically captured by the device and related Services: GPS/GNSS and positioning information; acceleration, gyroscope, magnetometer, g-force, step-rate, movement and impact information; metadata on workouts; duration of physical activity; performance, workload, movement, and impact metrics calculated or derived from such data or other data, such as top speed, total distance, effort or player load, acceleration, deceleration, acute-to-chronic workload ratio; and sport-specific metrics such as momentum or mass-in-motion scores (collectively, “Wearable Data”). Wearable Data may also include, where collected through a wearable device used with our Services, resting heart rate, heart rate variability, skin temperature, blood oxygen saturation level, and data reflecting strain and recovery. Any of the above listed wearable device information may also be added to our Services by you or your coaches or team admins when, for example, you are using a wearable device that does not connect automatically with our Services. You may also provide us with physiological profile information, including birthday, gender, weight, height, and fitness/athlete level. This information can be accessed by the athlete, coaches and team admins, and other third parties where directed by you. We may use some of this information to customize your experience with us as part of our Services. Where a wearable device is used at or in connection with a combine or athletic testing event, the resulting Wearable Data may also be shared with third-party combine operators, camp and athletic testing event operators, or licensors of Combine Data (“Combine Partners”) and with recruiters through Recruit, as described in Section 3. “Combine Data” means combine performance data and video, athletic testing and timing results, personal and contact information, and any Wearable Data captured at or in connection with a combine or similar type event.

When you browse our website(s), we may collect information about you, regardless of whether you have created a registered user account. However, if you choose to access our websites anonymously, we may not be able to provide you with particular Services. We collect and store personal information if you provide any such personal information, register as a user, use the Hudl support chatbot, visit our websites, provide details at an event, complete a survey or supply personal details through any other form of correspondence. Hudl uses this information to provide Services, as well as for billing, identification, authentication, Services improvement, customer service, contact and research purposes. This information may include: date, time, computer identity, crash data, device type and setting, operating system, language, region, log preferences, registration key, license level, license code, license code status, code registration date, last validation date, Ethernet address, IP address, MAC address, licensed software name and version, OS version, and any other information about user actions required to improve, support, and maintain our software.

In some cases, you may provide information to us about other people, such as employees, students, team members, family members, athletes, and potential donors for fundraising. This may occur when you fill out an Athlete Profile or other profile information, complete a registration for a Program, upload or capture game video, provide a contact list for fundraising solicitation, or seek parental consent through our Services.

Similarly, we may receive information about you from other users of the Services, such as coaches, admins, teammates, Parents (defined below in Section 9), or family members – for example, when a coach adds you to a roster, a Parent registers a child, or a family member connects with your account. We may also receive data about athletes from their coaches, admins, organizations, or team members, as more fully described in Section 3 of this Privacy Policy. We collect and protect this information in accordance with an agreement with the Customer the athlete is affiliated with.

We may receive personal information about you from third parties, including, but not limited to, from licensors of game video; Combine Partners; our Customers who create user-generated content (including Athlete Profile information, messages, comments, photographs, schedules, livestreams, audio recordings, videos, game replays, highlights, and text that users of our Services choose to create, capture, schedule, record, submit or upload to our Services); our users who are completing registrations for Programs; our payment processors; our partners who assist us in fraud prevention or in connection with claims or disputes; our partners with whom we work for advertising measurement, attribution, and analytics; and publicly available sources as part of a purchase, sale, merger or other business acquisition where personal information is transferred to us as an asset of the transaction, among other sources. When you pay for Services of ours using a credit card or other payment method, your credit card or other payment information is collected and processed by our third-party payment processors. For example, if you pay with a credit card, the payment information that you provide through our Services is transmitted directly to our payment processor. We may receive limited information about your payment card from our payment processors. Our payment processors will collect the financial information necessary to process your payments in accordance with the payment processor’s respective services agreement and privacy policy.

When you register yourself or your child for a Program offered by a Customer, we may collect documents and information specified by the Customer. This information may include, but is not limited to, birth certificates, medical waivers, proof of vaccination, proof of medical insurance, emergency contact information, and other information and documents requested by the Customer. 

Please note that if you choose to verify your age using a third-party age verification provider in order to provide parental consent, we do not collect, access, or store the specific identification documents that you provide to the third-party age verification provider. When provided as part of the parental consent process, we share your email address with the third-party age verification provider to facilitate the process and receive confirmation regarding your verification status.

Certain Hudl Services use our business partners’ application programming interfaces (“APIs”) to display player statistics. The data shown through the use of APIs is only temporarily stored on Hudl instances for a short time (often referred to as “caching”). Hudl displays API data when you request it by searching for a player or accessing a player profile. The data is permanently deleted shortly after you navigate to another page.

When logging into your Hudl account, you may use your Facebook, Google, or Apple account by providing your login information for those third-party services when prompted. If you choose to use this single sign-on feature, we may access, handle, and store any content and other information that you have provided through Facebook, Google, or Apple (as applicable). We do not and cannot control any policies or terms of any third party, including Facebook, Google, and Apple. All information you provide to Facebook, Google, or Apple is subject to the applicable privacy policy: see Facebook’s Data Policy, Google’s Privacy Policy, and Apple’s Privacy Policy. 

3. Athlete Profiles and Recruit

As an athlete, you may have an “Athlete Profile”, meaning a public-facing profile webpage hosted on the Services. On your Athlete Profile, you can document your athletic journey, post highlights, and facilitate discovery by recruiters, Fans, and other users. Your Athlete Profile is accessible to the general public by default, subject to settings in the Services. In some cases, parental consent may be required for your Athlete Profile to be public. You may also maintain additional profile information that is not public, which you may be able to make available to verified recruiters. 

Your Athlete Profile or your non-public profile information may contain (and therefore collect): name, user ID, home and email addresses, phone number, school (name, city and state), graduation year, GPA, ACT/SAT scores, transcripts, parent/guardian information (name, relation, email and phone), age, birth date, photograph, height, weight, jersey number, Social Media handle, sports position, performance scores (e.g., 40-yard dash, agility shuffle, power ball, vertical jump), speed and strength information, event/combine information (including registration, contact, participation testing, timing, and similar results), Combine Data, Wearable Data and derived metrics, sports awards, sports videos featuring the athlete, short biography written by the athlete, Customer(s) the athlete is affiliated with, and other Athlete Profile information, all as may be updated from time to time. This information can be accessed by the athlete, coaches, and team admins. Verified recruiters may access the profile information of athletes located outside the EU and of those athletes inside the EU who have affirmatively consented to this. Home and email addresses, phone number, GPA, ACT/SAT scores, transcripts, parent/guardian information (name, relation, email and phone), age, birth date, graduation year, event/combine information (including registration, contact, participation testing, timing, and similar results), Combine Data, Wearable Data and derived metrics, and sports awards are not available to the general public by default. To use Recruit and share this information with verified recruiters, you may be required to opt in to such sharing and, in some cases, obtain parental consent to use Recruit. Further, if you have a Recruit profile, it may also include game video, video images, highlights, academic physical data (e.g., height, weight), and statistics and your Combine Data provided by coaches and other third parties. 

Where an athlete accesses the Services as a student through a school, additional information is available in the Student Athlete Privacy Statement.

4. Hudl Fan

The Services include features for fans (collectively, “Hudl Fan”) that allow you to view games, highlights, livestreams, and other video content posted by Customers and their users; purchase event tickets and related items as well as subscriptions or access to livestreams or archived content; follow teams, conferences, leagues, or athletes; and make donations or purchase coupon books for team or organization fundraisers. When you use any of these features, you are using the Services as a fan. Using the Services as a fan doesn’t create a separate account – you use the same Hudl account you use for any other purpose. If you currently use the Services only as a fan, your account may later be used to create an Athlete Profile, join a team, register a child for a Program, or access other features available to you. Fans may be able to view some limited content without an account; however, most content requires a registered Hudl account. When using your Hudl Account as a fan, you are using it for your own personal purposes and not Customer purposes. 

When you view, purchase, or interact with content, including livestreams or archived video content, made available by a Customer, we may share your name, email address, how you logged in (such as through a Social Media login but not your login credentials) and details of the content you viewed or purchased from that Customer with that Customer. We may also share with the Customer any support inquiries you make related to those purchases.

If you purchase event tickets or related items through the Services, we may share your name, email address, and purchase details (e.g., the number and type of tickets and items you have purchased) with the Customer offering the event. We may also share with the Customer any support inquiries you make related to those purchases.

5. Parents and Family Members

If you are a parent or legal guardian, we may receive your contact information (such as your name and email address) from your child, from a coach or admin, or through a registration flow before you create an account. If you create an account, we will collect information about your use of the Services, as described in Section 2. When you establish a connection with your child, or connect with another parent or guardian (for example, by inviting them to connect with your child or accepting their invitation to connect with your child), we may also collect information about that connection, including the link between your account and your child's, the link between your account and the other parent's or guardian's, and a link with teams or Customers your child is affiliated with. We use this information to provide and operate the Services, process your purchases, and communicate with you about your child’s activity, or the activity of teams/Customers your child is affiliated with. Through your connection, and to the extent your child's team or organization allows, you may be able to access certain team content and communications, such as team videos, schedules, and messaging (see Section 14). Your child’s coach or team admin may be able to see that you are connected to an athlete on their roster, another parent, and have access to team content. Your connection with a child may also serve as part of the parental consent process described in Section 9.

6. Coaches and Admins

If you are designated a coach, team admin, or Customer admin, whether by the person who set up your account, by your team or Customer, or by someone at Hudl, you may use the Services through your own Hudl account and on behalf of a Customer. We may collect personal information about you in your coach or admin role, which may be provided by you or by the person who designated you as a coach or admin. This information may include your full name, email address, phone number, a list of teams or Customers you are affiliated with and your role(s) on those teams, and a list of athletes (team roster) submitted to the Hudl platform for a team or Customer you are affiliated with. We may also collect any content you choose to upload, create, or manage, in your coach/admin role or in any other role you may hold.

7. Data Storage

Hudl uses third-party vendors and hosting partners to provide the necessary hardware, software, networking, storage and related technology required to run the Services, and such third-party vendors may collect, process and store your personal information on behalf of Hudl. Hudl owns the code, databases, and all rights therein. Hudl incorporates reasonable administrative, physical, and technical safeguards designed to protect and secure personal information, including measures to protect against unauthorized access, disclosure, alteration, loss, and destruction. However, no data transmission over the internet, wireless transmission, or electronic storage of information can be guaranteed to be 100% secure. Please note that Hudl cannot ensure or warrant the security of any information you transmit via its websites or Services, and you do so at your own risk. 

8. Disclosures to Third Parties

There are circumstances where we may wish to disclose or are compelled to disclose your personal information to third parties. We may disclose your personal information to the categories of recipients (and for the purposes) listed below.

  • Our affiliates, subsidiaries, branches, and associated offices. We may disclose your personal information to our affiliates, subsidiaries, branches, and associated offices and other companies under common control and ownership for purposes consistent with this Privacy Policy and other business and operational purposes.

  • Our agents, representatives, resellers, and independent contractors. We may disclose your personal information to such third parties where related to their functions and services.

  • Our service providers, third-party partners, and subprocessors. We may disclose your personal information to third parties that provide services to us or provide features as part of our Services, including: cloud storage services, system hosting services, research partners, data security services, fraud prevention, payment processing services, delivery services, analytics services, legal services, professional services, age verification services, AI service providers, and other services.

  • Our Customers. We may disclose your personal information to Customers that you or your child are affiliated with. When you join a Customer’s team or roster (for example, as an athlete, coach, admin, or parent of an athlete), we may share personal information with that Customer as necessary to provide the Services. We may also disclose your personal information to Customers offering Programs and Customers offering streaming, archived content, tickets, custom items, and fundraising opportunities to fans, as described in this Privacy Policy. When you register yourself or your child for a Program offered by a Customer, we may collect documents and information specified by that Customer and may disclose such documents and information to that Customer. You can tell when a Customer or other third party is involved and we share your personal information related to those transactions and involvement with that third party. For donations and coupon book purchases, we may also share your name, email address, and transaction information with the Customer on whose behalf the fundraiser is conducted.

  • Recruiters through Recruit. Subject to any opt-in and parental consent requirements in the Services,  we may disclose to recruiters the categories of personal information described in Section 3 to allow an athlete to increase their recruiting visibility. 

  • Combine Partners. Where an athlete has directed a Combine Partner to share Combine Data with Hudl, we may also disclose certain personal information to Combine Partners in connection with combine or athletic testing events. This may include Wearable Data captured at or in connection with a combine, athlete identification and contact information, and performance or testing results. We disclose personal information to Combine Partners only where the athlete has authorized the sharing of such information in connection with their participation in the combine or event.

  • Our licensees. We may disclose your personal information to licensees of content where you, our Customers, or others have given us permission to share such content.

  • Our marketing and advertising partners. We may disclose your personal information to our marketing and advertising partners, including Social Media platforms, third-party advertising networks, and other parties to assist in serving and measuring our or their advertisements, in compliance with applicable law. We may disclose your personal information to business partners and third parties (e.g., other companies, Social Media platforms, third-party advertising networks, research organizations, publishers, and non-profit organizations) for their own purposes, including marketing products or services to you, showing you relevant advertising, or providing an enhanced experience that integrates with one of our Services. When required, we will ask for your consent or provide opportunities to opt-out.

  • Sponsors, co-promotions, and branded programs. We may offer content or programs (e.g., competitions, sweepstakes, promotions, games, applications, branded community or panel programs, or social media integrations) that are sponsored by or co-branded with third parties that may collect or obtain personal information from participants. When you participate in branded community or panel programs, your name and contact information may also be disclosed to such third parties or other participants or made public.

  • Other users of our products and services. We may disclose your personal information to other users of our Services if you choose to make such information public or you select sharing features on our Services. For example, if you share highlights publicly on the Hudl website, such highlights will be viewable by website visitors.

  • In connection with legal matters. We may share your personal information when we believe that the disclosure is reasonably necessary to comply with applicable laws, regulations, legal processes, or legal requests.

  • In connection with potential illegal activity, misuse, threats, or other situations. We may share your personal information when we believe that the disclosure is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of Hudl’s User Terms of Service, available at www.hudl.com/terms (“User Terms”) or Hudl’s Acceptable Use Policy, available at www.hudl.com/aup (“AUP”), or as otherwise required by law.

  • Third parties in connection with a sale or business transaction. We may disclose your personal information in the course of the following transactions involving one or more Hudl entity: joint venture, collaboration, financing, sale of assets, merger, reorganization, change of legal form, other sale or purchase of assets during the normal course of business on a temporary or permanent basis, dissolution, or similar event. If another entity acquires us (or any subsidiary or affiliated entity) or any of our (or such subsidiary’s or affiliate’s) assets, personal information that we have collected may be transferred to such entity and its advisors leading up to and following the transaction, including as part of due diligence and upon closing of the transaction. In addition, if any bankruptcy or reorganization proceeding is brought by or against us, personal information that we hold may be considered an asset of ours and may be sold or transferred to third parties.

  • Other third parties. We may disclose your personal information to other parties at your direction or with your consent. We may also disclose your personal information to other parties if we believe it necessary or appropriate either: (a) under applicable law; (b) to protect our operations and those of any of our affiliates; (c) to protect our rights, privacy, safety or property, and those of others; or (d) to allow us to pursue available remedies or limit damages that we may sustain.

We may disclose your personal information for other reasons that we will describe at the time of information collection or prior to sharing your information. Any disclosure to third parties will only take place in accordance with the applicable law and for the purposes listed. Except as otherwise provided by applicable law, Hudl is not responsible for the privacy practices of any third parties.

9. Children

Some of the features on our Services require creation of an account and require age verification. As part of this account creation process, if we learn that a user is under the age of 13, we will send a message to the child’s parent or guardian (“Parent”) seeking verified parental consent and providing the Parent notice of a limited experience we provide to a child before we obtain the Parent’s consent. The following describes how we collect, use, and disclose personal information from children under 13 before and after verified parental consent. For children that access our Services as students through a school, their use may be subject in whole or in part to our agreement with their school and school officials.

Before we receive parental consent.

Unless and until we receive parental consent, we only collect personal information from children (or their coach) in the form of first and last name, the email address of the child and their Parent, and persistent identifiers such as a cookie or device identifier and Internet Protocol (IP) address. We may use the child’s name and email address to send the child essential and informational notifications or updates about our Service. We collect the email address of the child’s Parent to notify the Parent that the child has been granted access to a limited account and is registered to receive online communications from us, to provide the Parent with direct notice about how we collect and use their child’s information, and to seek verified parental consent to allow the child to use a less limited account. If a Parent does not respond to the direct notice email, we will use the child’s online contact information for the purpose stated in this Section 9. When the child uses our Services, we only use their personal information for these communications and to support our internal operations necessary to maintain and analyze the functioning of the website, perform network communications, protect the security or integrity of users, and ensure legal and regulatory compliance. The child’s personal information will not be used for any other purpose, disclosed, or combined with any other information collected from the child. The child will not be able to opt into or receive notifications, and we do not collect push notification identifiers from children prior to parental consent. Steps we take to ensure that this data is not used or disclosed for any other purposes include, limiting any social, sharing, messaging, or chatbot features available to the child, restricting access to certain additional Services and features until a Parent provides consent, and limiting access to Recruit. The child’s Parent may refuse to permit further contact with the child and can request deletion of the Parent’s and child’s online contact information by responding to the initial direct notice email from Hudl or contacting support@hudl.com.

After we receive parental consent.

After we receive parental consent, we will collect the same type of information we describe above in Section 2 and Section 3 and elsewhere in this Privacy Policy.Children may opt into notifications after parental consent, though Parents may disable notifications at any time through the child’s app or account settings or by contacting support@hudl.com. 

We may disclose personal information we collect from children as described in Section 8. However, unless we have your express consent, we do not sell or share that information with third parties for their own purposes, including with our Customers or with marketing and advertising partners. 

Optional features and granular parental consent.

With express consent of Parents, children can access optional features that allow them to interact, share content, or make information public. Parents may consent to each feature independently and can change or revoke their consent at any time by responding to the consent email or contacting support@hudl.com. These optional feature-related purposes include: 

  • Team Space: Allows your child to join a roster, message coaches and teammates, access their team’s videos, calendar and insights, and any additional team-level products or features made available through the Services.

  • Favorites: Allows your child to favorite or express preferences for teams, athletes, events, content, and other items available on the Services, and enables us to use those preferences to personalize your child’s experience across the Services, including activity feeds, recommendations, notifications, and content discovery. 

  • Highlights: Allows your child to create, edit, and share highlights and other content showcasing your child’s athletic performance, including video, statistics, AI-generated, or data-derived content. Highlights may be shared with other users, teams, or organizations through the Services, and, if Public Profile is enabled, may also be made available to the general public.

  • Public Profile: Allows your child to create and maintain a public-facing profile on the Services, including an Athlete Profile, containing content, personal information, and performance data that may be visible to anyone on the internet, including through search engines and third-party services. Profile information may be updated over time as your child uses the Services.

  • Recruit: Allows your child to use Hudl's recruiting and athletic opportunity tools, including making profile information, performance data, and related content available to recruiters, scouts, and other recruiting-related services through the Services. While your child is under age 13, their private recruiting profile information on Hudl  will not be shared with or discoverable by recruiters on Recruit. Once your child reaches age 13, they may choose to activate these features. For details about the categories of information available through Recruit, see Section 3.

Retention of Personal Information

We may retain personal information we collect from children for business purposes and for periods described in Section 15. We retain personal information collected from your child only for as long as necessary to fulfill the purposes for which we have collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements, unless longer retention is required by applicable law. Hudl maintains a written data retention policy for children’s personal information that sets forth the purposes for collection, the business needs for retention, and a timeframe for deletion.

Providing and Revoking Parental Consent

Parents can review the child’s personal information, request that we delete the child’s personal information, and refuse to permit further collection or use of the child’s information. To exercise any of these rights, or to send general inquiries, Parents can contact our support team by emailing support@hudl.com or visiting our Contact Hudl Support webpage. Parents can also send inquiries to our contact information found in Section 22.

Contextual Advertising for Children and Minors

We may use personal information we collect from children as described in Section 1, except that we do not use that information for behaviorally targeted advertising, and we do not allow children to livestream. We use Google to display contextual advertisements selected based on the content currently being viewed. We and Google may collect persistent identifiers, such as IP addresses, cookies, or device identifiers, only as needed to deliver contextual advertisements, limit advertising frequency, measure ad delivery, maintain advertising services, prevent fraud, protect security, and comply with legal or regulatory requirements.

We configure advertising requests to apply age-restricted treatment appropriate for children and minors. We do not permit these identifiers to be used for behavioral or interest-based advertising, remarketing, contacting a specific individual, building an individual profile, or any other unauthorized purpose. We use contractual and technical controls, monitoring, and retention limits to enforce these restrictions.

We retain persistent identifiers only as long as reasonably necessary for these purposes. Google states that it anonymizes advertising log data by removing part of the IP address after nine months and cookie information after 18 months. Google may retain certain information longer when necessary for security, fraud prevention, or legal obligations.

10 Web Beacons

Our website uses techniques (generally, single-pixel images embedded in a web page) called “Web Beacons”. Web Beacons allow Hudl and third parties to monitor and collect information about the viewer of the web page, web-based document, email message or other communication, such as the type of browser requesting the web beacon, the Device Identifier that the web beacon is sent to, and the time the web beacon was viewed. Hudl uses web beacons to count web browsers, visits, and page views. We also use beacons to monitor traffic and conversion patterns, to personalize your experience, including advertising and content, and to determine whether or not messages were opened, links were clicked, or notifications/offers were acted upon.

11. Cookies

A cookie is a small amount of data that often includes an anonymous unique identifier that is sent to your browser from a website and stored on your computer’s hard drive. When you access this website, cookies may be sent to your web browser and stored on your computer or mobile device. We use cookies to record information about your online preferences and allow us to tailor our websites to your interests. Information supplied by cookies can help us to understand the profile of our visitors and help us to provide you with a better user experience. It also helps us to recognize when you are signed in to your Hudl account and to provide a more personalized experience. Additionally, Hudl uses cookies to serve some targeted advertising. To help promote Hudl teams and athletes, we sometimes embed content from social media and other third-party websites. These may include Vimeo, YouTube, X, Facebook, SoundCloud, Spotify, LinkedIn, Instagram, and Flickr ("Social Media"). As a result, when you visit a page containing such content, you may be presented with cookies from these websites and these third-party cookies may track your use of the Hudl website. Hudl does not control the dissemination of these cookies and you should check the relevant third party's website for more information.

12. Hosted Service Partners and Their Privacy Options

Our major network advertising partners include Facebook, Google, X, LiveRamp, Amobee, and their respective advertising networks. These partners may use cookies, web beacons, and similar technologies to collect information and use that information to provide measurement services and target ads. If you wish to restrict, remove or refuse to accept cookies which are set by any website (including this website), you should do this through the browser settings for each browser you use to access the internet. The Help function within your browser should tell you how to do so. Some browsers have a “do not track” feature that lets you tell websites you do not want to have your online activities tracked. We respond to “do not track” signals as required by applicable law.

13. Third Party Websites

Some links on the Hudl websites may redirect you to third-party websites and services that we do not operate. We may also offer social sharing tools that let you share actions on the Hudl website with other websites and vice versa. The privacy practices of these websites and services will be governed by their own privacy policies. We encourage you to review and understand their privacy policies before disclosing any personal information to them.

Online training sessions are governed by the privacy policy of a separate company. If you attend an online training session, we will disclose to you the separate company providing the training platform.

14. Hudl Messaging

Hudl’s private messaging tools (“Hudl Messaging”) may be available through the Services. Messages may be between one sender and one or more recipients. Hudl Messaging enables users to have conversations with athletes, coaches, parents or family members (if available), custom groups, the whole team on the same Hudl roster, or the whole organization (if available). Hudl Messaging is intended for use that includes, but is not limited to, sending reminders about practice times, requesting feedback from the team, discussing game strategy, or sharing links to training resources.

Hudl Messaging may allow users to invite family members to conversations. A family member can participate in Hudl Messaging once connected to an athlete on a team. Team admins and coaches retain the right to manage, restrict, or remove a family member’s access to Hudl Messaging or the team at any time.

When a message is sent, all participants in the conversation (except the sender) receive a notification within Hudl Messaging that they have a new unread message.

Once a message is deleted from the sender’s personal account, it is deleted from the recipient(s’) account(s) as well. Neither the recipient nor the sender is then able to see the message. Once the message is deleted, the action cannot be undone. Any information the sender submits through Hudl Messaging, however, may be passed along by the recipient without the sender’s knowledge. This may occur by forwarding the notification email or text, or capturing and forwarding a screenshot of the message(s) prior to deletion.

Hudl supports the privacy and competitiveness of teams by requiring authentication to view the messages and files shared within Hudl Messaging. Hudl reserves the right, but is not obligated to, disclose any information if, in its sole opinion, Hudl suspects or has reason to suspect that the information involves a party who may be the victim of harassment in any form. Information may be disclosed to authorities that Hudl, in its sole discretion, deems appropriate to handle such disclosure. Appropriate authorities may include, without limitation, law enforcement agencies, child protection agencies, or court officials. Additionally, Hudl reserves the right to divulge the contents of a communication to an addressee or intended recipient of such communication. Given this, even if both the sender and recipient(s) deleted their message(s), conversation(s) directed at either party may be provided to the individual at either party’s request.

We may also use aggregated Hudl Messaging information for purposes such as auditing, data analysis, and research to improve Hudl’s Services, and customer communications. Hudl will not share with any partners any information provided via Hudl Messaging, except on aggregate, unless explicitly approved by the Customer or team admin.

We reserve the right to access Hudl Messaging information when necessary to investigate, prevent, or take action regarding illegal activities, including suspected fraud, harassment, and threats to the safety of any person, as well as violations of the User Terms or AUP, or as otherwise required by law.

15. Retention of Personal Information

We keep personal information only for as long as necessary to fulfill the purposes for which we collected it, as set out in this Privacy Policy, including to provide and support the Services and to satisfy any legal, accounting, or reporting requirements, unless longer retention is required by applicable law. We also retain information when necessary to comply with contractual and legal obligations, when we have a legitimate business interest to do so (such as improving and developing our Services, and enhancing their safety, security and stability), and for the exercise or defense of legal claims. We will not retain any of your personal information beyond this period and the retention of your personal information will be subject to periodic review.

To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information; the potential risk of harm from unauthorized use or disclosure of the personal information; the purposes for which we use the personal information; whether we can achieve those purposes through other means; and the applicable laws that require us to retain information for regulatory purposes or permit us to retain the information to preserve our legal rights.

We may put your personal information in an aggregated, de-identified, pseudonymized, or anonymized form for statistical, research, development, security, or service-improvement purposes without time limits, to the extent we have a legitimate and lawful interest in doing so and such information is no longer associated with an identifiable individual. If we do so, such information will no longer be personal information subject to this Privacy Policy.

16. Confidentiality and Security

Hudl is committed to seeking to safeguard personal information that you provide to us; seeking to ensure that it remains confidential and secure; and taking reasonable steps to ensure that personal privacy is respected. All our data is stored in written or electronic form on our servers and computers and in various physical locations. We maintain reasonable physical, technical, and administrative safeguards to protect your personal information from misuse, unauthorized access or disclosure, and loss or corruption by computer viruses and other sources of harm. We limit access to personal information to those staff members, joint venture partners, subsidiary companies and third parties who need to know that information for the purposes set out in this Privacy Policy or as required by applicable law.

17. Grounds for Processing in the UK/EEA

If you are in the United Kingdom and/or European Economic Area, where Hudl acts as a Data Controller, to process your data lawfully we need to rely on one or more valid legal grounds. The grounds we may rely upon include: (1) your consent to particular processing activities. For example, where you have consented to us using your information for marketing purposes; (2) our legitimate interests as a business (except where your interests or fundamental rights override these). For example, it is within our legitimate interests to use your data to send you our electronic newsletter and product updates if you represent a corporate entity (unless you have unsubscribed); (3) our compliance with a legal obligation to which we are subject. For example, we have a duty to investigate and respond to complaints made against us and may need to process your personal information as part of such investigation; or (4) if you are a Customer, or are representing a Customer, because processing your personal data is necessary for the performance of a contract.

18. Your European Data Protection Rights

Data protection law applicable to individuals in Europe provides individuals with certain rights, including the right to access, rectify, withdraw consent, erase, restrict, transport, and object to the processing of their personal information. Individuals also have the right to lodge a complaint with the relevant information protection authority if they believe that their personal information is not being processed in accordance with the law. Further information about your rights is set out below:

  • Right to obtain a copy of your personal information. You may have the right to obtain a copy of the personal information we hold about you.

  • Right to rectification. You may request that we rectify any inaccurate and/or complete any incomplete personal information. If we disagree and believe the information to be accurate and complete, we will advise you and include a notation on the record that you dispute the information’s accuracy. We will respond to your request to correct or supplement your personal information within a reasonable time period and, in any event, within any time period specified in relevant laws.

  • Right to withdraw consent. You may, as permitted by law, withdraw your consent to the processing of your personal information at any time. Such withdrawal will not affect the lawfulness of processing based on your previous consent. Please note that if you withdraw your consent, you may not be able to benefit from certain service features for which the processing of your personal information is essential.

  • Right to object to processing. You may, as permitted by law, request that we stop processing your personal information. You also have the right to ask us not to process your personal data for marketing purposes.

  • Right to erasure. You may request that we erase your personal information and we will comply, unless there is a lawful reason for not doing so.

  • Your right to lodge a complaint with the supervisory authority. We suggest that you contact us about any questions or if you have a complaint in relation to how we process your personal information. However, you do have the right to contact the relevant supervisory authority in the relevant country directly. In the UK, this is the Information Commissioner’s Office at https://ico.org.uk.

  • Automated Decision Making. We do not use automated decision making, including profiling, to produce a legal or similarly significant effect. If you have any questions about how we use automated decision making, you can contact us at dpo@hudl.com, with a cc to legal@hudl.com.

19. International Transfer of Personal Data

Individuals in the European Union and the UK should be aware that Hudl may transfer your personal data to a third party in countries outside the EU or the UK for further processing in accordance with the purposes set out in this Privacy Policy. In particular, your personal data may be transferred throughout the Hudl group and to our outsourced service providers located abroad. In these circumstances, we will, as required by applicable law, ensure that your privacy rights are adequately protected by appropriate technical, organizational, contractual or other lawful means.

All data that Hudl sends out of the EU/EEA/UK is sent to countries with an EU or UK adequacy status, as applicable, or to organizations with signed EU Standard Contract Clauses or UK Standard Contractual Clauses. Hudl transfers data between its group of companies, for which the international transfers of EU/EEA/UK data are detailed within Hudl’s Intra-Group Data Transfer Agreement, which itself includes the required EU Standard Contract Clauses and UK Standard Contractual Clauses.

All Hudl data transfers to the US are TLS encrypted and generally consist of insensitive personal data. Hudl therefore believes the risk of government surveillance to the privacy of transferred personal data to be very low. Additionally, Hudl will only provide personal data to applicable law enforcement authorities when under strict legal compulsion. When permitted by applicable law, law enforcement and exigencies of time, Hudl will notify its Customers of any such legal requests involving their personal data.
